End User License Agreement

1. License Grant

InvoXtreme ("Licensor") grants you a non-exclusive, non-transferable, limited license to install and use InvoXtreme Desktop ("Software") solely for your personal or business purposes in accordance with the terms of this Agreement.

1.1 Permitted Use

You may:

  • Install the Software on up to three (3) devices that you own or control
  • Make one (1) copy of the Software for backup purposes
  • Use the Software for commercial email marketing purposes

1.2 License Type

The type of license you receive depends on your purchase:

  • Basic License: Up to 5,000 emails per day, 5 SMTP accounts
  • Professional License: Up to 50,000 emails per day, unlimited SMTP accounts
  • Enterprise License: Unlimited emails per day, unlimited SMTP accounts

2. Restrictions

You shall not:

  • Copy, modify, or create derivative works of the Software
  • Reverse engineer, disassemble, or decompile the Software
  • Rent, lease, lend, sell, redistribute, or sublicense the Software
  • Remove any proprietary notices or labels from the Software
  • Use the Software for any unlawful purpose or in violation of any regulations
  • Share your license key with unauthorized users
  • Use the Software to send spam or unsolicited emails
  • Bypass or attempt to bypass license restrictions

3. Intellectual Property Rights

The Software is licensed, not sold. This Agreement does not transfer to you any intellectual property ownership rights. InvoXtreme and its licensors retain all right, title, and interest in and to the Software, including all copyrights, patents, trade secrets, trademarks, and other intellectual property rights.

4. Updates and Maintenance

The Licensor may provide updates, patches, bug fixes, or other modifications to the Software ("Updates"). Updates are governed by this Agreement unless other terms accompany the Updates. The Licensor is not obligated to provide any Updates or support services.

  • Basic License includes 1 year of updates
  • Professional and Enterprise Licenses include lifetime updates

5. Data Collection and Privacy

The Software may collect certain data to improve functionality and user experience. By using the Software, you consent to the collection and use of this information as described in our Privacy Policy. We are committed to protecting your privacy and handling your data responsibly.

6. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.

7. Limitation of Liability

IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF THE LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Software and destroy all copies.

9. Refund Policy

NO REFUNDS: All sales are final. We do not offer refunds under any circumstances. Please review our Non-Refund Policy before purchasing.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the courts located in India.
